Without written permission from Judicial Magistrate
Exceptions to This Rule
A woman police officer can make the arrest after obtaining written permission from Judicial Magistrate First Class.
In cases involving ongoing commission of a cognizable offense where delay would let the accused escape.
Additional Protection for Women
Arrest must be made by or in presence of a female police officer
Only by a female doctor with another woman present
Male officers cannot physically touch a woman during arrest
Women must be kept in separate lock-up under female guard
If Police Try to Arrest After 6 PM
- Politely state: "Under Section 46(4) of CrPC, you cannot arrest me without Magistrate's permission after 6 PM"
- Ask to see the written permission from Judicial Magistrate
- If no permission shown, ask them to come back the next morning
- Call a family member or lawyer immediately
- Record the interaction if possible (legal in public places)
- If forced, note badge numbers and file complaint later
